La iniciativa enviada por la presidenta Claudia Sheinbaum para reformar la Ley de Amparo encendió las alarmas en la oposición. Senadoras del PRI y Movimiento Ciudadano denunciaron que el verdadero trasfondo de esta propuesta no es modernizar la justicia, sino limitar derechos, reducir contrapesos y facilitarle al gobierno el camino para cobrar más impuestos con menos obstáculos legales.
La senadora priista Claudia Anaya advirtió que esta reforma “pretende quitarle al justiciable mecanismos de defensa, dejando menos posibilidades de consolidar sus derechos y más facilidades para que las autoridades recauden”. Según la legisladora, aunque la iniciativa se maquille con tintes fiscales, el efecto real será que los ciudadanos tendrán menos armas para enfrentar abusos de autoridad.
Por su parte, la senadora Alejandra Barrales, de Movimiento Ciudadano, fue más dura: “Lo que busca el gobierno es control político. Limita a quien puede acceder al juicio de amparo y restringe las facultades de los jueces. En pocas palabras, no quieren contrapesos ni que el Poder Judicial siga siendo un freno al poder presidencial”.
Ambas legisladoras coincidieron en que esta iniciativa representa un riesgo directo al acceso a la justicia y a la división de poderes. Para la oposición, el mensaje es claro: mientras el gobierno habla de fortalecer el Estado, en los hechos avanza hacia un escenario donde los ciudadanos estarán más indefensos y el Ejecutivo más fortalecido.
La polémica apenas comienza, pero la pregunta de fondo es inevitable: ¿se trata de una modernización legal o de un golpe quirúrgico al último bastión de defensa ciudadana frente al poder?
